These Terms of Service ("Terms") govern your access to and use of the TiC Rate Gap Scanner website and services operated by TiC Rate Gap Scanner ("we," "us," or "our"). By accessing or using our service, you agree to be bound by these Terms.

1. Service Description

TiC Rate Gap Scanner provides health insurance rate analysis reports ("Price Gap Reports") based on publicly available federal Transparency in Coverage (TiC) data published under the CMS Transparency in Coverage rule. Our service includes:

  • A free Price Gap Report comparing your employer's health insurance rates to comparable employers in your area
  • Paid analysis packages (Rate Comparison Pack, Negotiation Evidence Vault) - currently in development
  • General information about the federal TiC mandate and health insurance pricing

2. Eligibility

Our service is intended for use by business professionals - specifically CFOs, HR Directors, and other decision-makers at US-based employers. You must be at least 18 years of age and authorized to submit information on behalf of your employer to use our services.

3. Acceptable Use

You agree to use our services only for lawful purposes. You may not:

  • Submit false or misleading information in our forms
  • Attempt to access or interfere with our systems without authorization
  • Use automated tools to scrape or harvest data from our website
  • Resell or redistribute our reports without written permission
  • Use our reports for any purpose that violates applicable law

4. Disclaimer - Reports Are Informational Only

Important: Price Gap Reports and all other analysis we provide are for informational purposes only. They are not:

  • Insurance advice or actuarial analysis
  • A guarantee of specific savings or negotiation outcomes
  • Legal, financial, or regulatory advice
  • A substitute for professional insurance consulting

Rate data is derived from publicly available federal files, which may contain errors or may not reflect the most current negotiated rates. Actual rates and savings opportunities will vary based on your specific plan design, employee demographics, utilization patterns, and negotiation outcomes.

We strongly recommend consulting with qualified insurance professionals before making decisions about your health insurance coverage based on our reports.

5. Intellectual Property

The TiC Rate Gap Scanner website, brand, and methodology are owned by us. The underlying federal TiC rate data is public domain, published under the CMS Transparency in Coverage mandate. Our original analysis, formatting, scoring methodology, and report design are proprietary.

Reports delivered to you are licensed for your internal business use only. You may not redistribute, publish, or commercialize report content without our written consent.

6. Limitation of Liability

To the maximum extent permitted by applicable law, TiC Rate Gap Scanner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Losses arising from reliance on report data in insurance negotiations
  • Costs of obtaining substitute services
  • Any data loss or corruption

Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim. For free services, our total liability shall not exceed $100.

7. Indemnification

You agree to indemnify and hold harmless TiC Rate Gap Scanner, its affiliates, and their respective officers, directors, and employees from any claim, liability, damage, or expense (including reasonable attorney fees) arising out of your use of our services, your violation of these Terms, or your violation of any third-party rights.

8. Privacy

Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference.

9. Modifications to Service

We reserve the right to modify, suspend, or discontinue any aspect of our service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes affecting paid services.

10. Modifications to Terms

We may update these Terms from time to time. Continued use of our services after any changes constitutes your acceptance of the updated Terms. We will post the effective date of the most recent update at the top of this page.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TiC Rate Gap Scanner regarding use of our services, superseding any prior agreements.
